APPENDIX 5: C14 Government Contracting
All procurement processes in place within the Department comply with the procurement legislative framework including the Government Procurement Act 2001, Government Procurement Regulation 2007 and subordinate guidelines and circulars. Confirmation of the procurement selection and management processes is authorised by the appropriate Delegate within the Department.
Under whole of government procurement arrangements, ACT Procurement Solutions continues to provide advice and support in relation to procurement and contract management issues, and undertakes higher value procurement activities on behalf of the Department.
The Department continues to be responsible for the management of contracts. Where contractor obligations are not met, including their responsibility to comply with employment and industrial relations conditions, the contractor is required to rectify the non-compliance immediately to avoid cancellation of the contract.
During the year, the Department undertook a significant review of school cleaning contracts in consultation with industry and relevant unions. Improvements to the existing arrangement are scheduled for 2010-11 including an update to the Statement of Requirements, more formalised contract management performance monitoring as well as streamlined procurement processes.
The Department's central office expenditure included the acquisition of expert advice regarding curriculum, national assessment testing, other education related matters, human resource issues and capital activities.
Contract information for schools related mainly to capital works, site maintenance and security issues. The range of specific contracts includes repairs and maintenance cleaning, grounds maintenance and security. All contracts for capital works and repairs and maintenance are organised through either ACT Procurement Solutions or the ACT Property Group in the Department of Territory and Municipal Services.
